Adoptée dans un climat politique tendu après le rejet des motions de censure, la loi de finances 2026 confirme une inflexion notable de la fiscalité immobilière pour le logement nu. Avec le désamour des Français pour la location nue, la location meublée, portée par une fiscalité plus avantageuse et par les plateformes de type AirBnb, a connu un véritable essor ces dernières années. Pour que la location nue à usage de résidence principale devienne plus attractive, le gouvernement a présenté ce dispositif dans sa loi de Finances 2026. De quoi il s’agit exactement ?

Vers une fiscalité plus équilibrée

Alors que le régime micro-BIC de la location meublée a bénéficié durant longtemps d’abattements nettement plus important que celui du micro-foncier de la location nue, les parlementaires ont plusieurs fois abaissé ou conditionné ces abattements ces dernières années. Aujourd’hui, la volonté est différente. Il s’agit de rendre plus attractif la location longue durée nue pour un usage de résidence principale.

Dans son régime réel de droit commun, la location meublée bénéficie de l’amortissement qui réduit voire neutralise l’impact fiscal des revenus perçus. Le choix du gouvernement est de se permettre aux propriétaires de logements nus et sous condition, de bénéficier également d’un amortissement.

Amortissement de 3 %/an sous condition de travaux, soit concourant à la livraison d'un immeuble neuf, soit de réhabilitation lourde représentant 30 % du prix du bien en location intermédiaire + bonus d'amortissement :

  • + 0,5 point pour la location sociale (3,5 %)
  • + 1 point pour la location très sociale (4 %)

Seulement pour la location intermédiaire en référence au logement locatif intermédiaire (LLI) (sous condition de ressources et de loyers)

Possibilité d'imputer le déficit foncier sur le revenu global

Oui dans la limite de 10 700 euros

Prorogation pendant deux ans de la possibilité d'imputer les dépenses de travaux de rénovation énergétique dans un plafond relevé à 21 400 euros

Engagement de mise en location

Engagement de mise en location pendant 9 ans minimum en tant que résidence principale

Plafonnement de l'amortissement

Limitation de déduction d'amortissement à 8 000 euros/an/foyer fiscal et bonus d'amortissement :

  • 10 000 euros pour la location sociale
  • 12 000 euros pour la location très sociale

Cumul de l'amortissement plafonné à la valeur d'acquisition du bien, hors foncier, éventuellement majorée des travaux

Durée d'application

Logements acquis entre la publication de la loi de finances pour 2026 et le 31 décembre 2028

Adopted in a tense political climate following the rejection of motions of no confidence, the 2026 Finance Act confirms a significant change in property taxation for unfurnished accommodation. With the French losing interest in unfurnished rentals, furnished rentals, boosted by more advantageous taxation and platforms such as Airbnb, have boomed in recent years. To make unfurnished rentals for use as a primary residence more attractive, the government has introduced this scheme in its 2026 Finance Act. What exactly does it involve?

Towards a more balanced tax system

While the micro-BIC regime for furnished rentals has long benefited from significantly higher allowances than the micro-foncier regime for unfurnished rentals, parliamentarians have repeatedly lowered or restricted these allowances in recent years. Today, the aim is different. The goal is to make long-term unfurnished rentals more attractive for use as a primary residence.

Under the standard tax regime, furnished rentals benefit from depreciation, which reduces or even neutralises the tax impact of the income received. The government has decided to allow owners of unfurnished properties, under certain conditions, to also benefit from depreciation.
